1. GENERAL PROVISIONS
These general conditions of sale ("General Conditions") apply to the offer and sale of products through the website www.elelshop.it ("Site").
To purchase products through the Website, customers must: (a) be eighteen years of age or, if minors, be duly authorized by their legal representative; (b) be consumers, understood as natural persons who act for purposes unrelated to their commercial, craft, entrepreneurial or professional activity; (c) be registered on the Site; and (d) hold a valid credit card.
2. IDENTIFICATION OF THE SELLER
The seller is Profumeria Elle SRL., an Italian company with registered office in via Piazza Vittorio Emanuele II, 68, 00185 Rome RM, VAT number 13759001004.
Product information is available on the Site, and is provided in accordance with Articles 52 and 53 of the Consumer Code.
Profumeria Elle undertakes to ensure that the details, descriptions and images of the products appearing on the Site are correct at the time the relative information is entered; however, within the limits allowed by law, it does not guarantee that these details, descriptions, product images are accurate, complete, reliable, up-to-date or error-free.
The products described on the Site are for personal use only. The customer is not allowed to sell or resell the products or promotional samples of any products received. Profumeria Elle reserves the right, with or without notice, to terminate or reduce any supply of products or promotional samples if, at its discretion, it has reason to believe that the behavior held by the customer may result in violation of these General Conditions.
All product prices displayed on the Site are inclusive of VAT according to current rates, and are expressed in Euros. The delivery costs indicated separately in the order form must be added to the product prices.
Elle Perfumery regularly verifies that all the prices displayed on the Site are correct, without, however, guaranteeing the absence of errors. If there is an obvious error in the price of a product, Elle Perfumery will offer the customer the opportunity to purchase the product at the correct price, or to cancel the order.
5. SENDING THE ORDER
The customer will be guided in the process of sending an order through a series of simple instructions on the Site.
To send an order, the customer must select the quantity of products he wishes to purchase in the quantity box.
To insert the selected product in the desired quantity inside the cart, the customer must click on the "Add to cart" icon. At any time during shopping the customer can view the products contained in the cart by selecting the icon at the top right of the page on which the number of added products will be visible, and then select the "go to cart" option. The customer can save a product as a favorite, selecting the heart-shaped icon in each product. The product will then be moved to the "My wishlist" page located inside the footer, in the "My Elle" section. To access the "My wishlist" page from any computer, the customer must register or log in via his account.
The customer must follow the instructions provided on the Website to complete the order fulfillment. The customer can always correct the errors in the data entered, or change the contents of the cart by adding or removing one or more products, or cancel the entire order before sending it. By placing an order, the customer acknowledges and declares to have read all the instructions provided during the checkout process and to accept these General Conditions without reservation. The customer can send an order for the selected products through the Site by clicking on the "Confirm" icon at the end of the purchase procedure.
Once the order has been sent, the message "Thank You" will appear, and the customer will soon receive an order confirmation by email. In accordance with Article 53 of the Consumer Code and Article 13 of the Ecommerce Decree, the confirmation email for the receipt of the order contains a summary of the General Conditions, information on the essential characteristics of the products purchased, a detailed indication of the price and means of payment, information on delivery costs, information on the conditions and methods of exercising the right of withdrawal geographical address to which it is possible to present complaints, information on assistance services and existing commercial guarantees.
If the confirmation of receipt of the order does not arrive within the 24 hours following the dispatch of the order, the customer is invited to request assistance by calling 06 9151 1288.
For questions or problems during the order process or for information about previously transmitted orders, the customer is invited to call 06 9151 1288 or write to the following email address info@Elleshop.com. For a faster service, it is advisable to keep the order number available.
6. AVAILABILITY OF PRODUCTS
To cancel, before shipping and for any reason, an order awaiting evasion for the temporary non-availability of the product, the customer can call 06 9151 1288 or write to the following email address: info@Elleshop.com.
Once the product has been shipped, the order cannot be canceled or modified. However, the products shipped may be returned in accordance with the provisions of these General Conditions.
All orders are processed and delivered on weekdays (Monday to Friday, excluding holidays). Orders placed on Saturday and Sunday will not be processed until the following Monday.
Deliveries of products to PO Boxes will not be made.
Shipping costs are charged to the customer and are shown separately in the order form and in the transport document. Shipping costs are free for purchases exceeding the amount indicated on the Site.
8. RIGHT OF WITHDRAWAL
The goal of Elle Perfumery is to offer its customers the best cosmetic products. If a product does not meet the customer's expectations, in accordance with Article 64 of the Consumer Code, the customer has the right to withdraw from the contract, without specifying the reason, within 14 (fourteen) working days from receipt of the products.
The customer can communicate his intention to withdraw by email to the following address info@Elleshop.com, indicating the details of the order, including the order number and the description of the products to be returned. Inside the delivered package, the customer will find a transport document with the details of the order and a description of how to return the products. If the products listed in the transport document do not coincide with those delivered, the customer is invited to contact Elle Perfumery immediately by calling 06 9151 1288.
It is recommended to send the package by registered letter with return receipt. Elle Perfumery assumes no responsibility for products lost during transport.
The foregoing provisions apply only to products purchased on the Site. Returns or replacements for purchases made in a MAC store or at an affiliated retailer may not be made through the Site.
9. APPLICABLE LAW AND JURISDICTION
These General Conditions are governed by Italian law and must be interpreted in compliance with Italian laws.
Any dispute arising from the interpretation, validity and / or execution of these General Conditions will be subject to the mandatory jurisdiction of the court of the customer's place of residence or domicile.
